Libya Elections: Burying The Amnesty Report.

In January 2005, we described how the British media were united in celebrating Iraq’s ‘first free election in decades’. (Leader, ‘Vote against violence,’ The Guardian, January 7, 2005)
The BBC’s main evening news reported ‘the first democratic election in fifty years’ (BBC1, News at Ten, January 10, 2005). The Daily Telegraph wrote of ‘the first democratic elections’ (Leader, ‘Mission accomplished,’ Daily Telegraph, December 6, 2004). The Independent argued that ‘democratic and free elections can bring a hope of peace’ (Borzou Daragahi, ‘Bin Laden backs deputy Zarqawi,’ The Independent, December 28, 2004).
In their excellent book, Demonstration Elections (South End Press, 1984), Edward Herman and Frank Brodhead listed six criteria of election integrity:

‘Freedom of speech.’
‘Freedom of the media.’
‘Freedom of organization of intermediate groups.’
‘The absence of highly developed and pervasive instruments of state-sponsored terror.’
‘Freedom of party organization and ability to field candidates.’
‘Absence of coercion and fear on the part of the general population.’

As Herman and Brodhead noted, a good way of ‘looking at the validity of elections is to examine the conditions making for a free election and see how the actual electoral case conforms to these criteria.’

But this the US-UK mass media never seriously attempt to do in covering elections in states newly ‘liberated’ by the West. Instead:

‘Following the government’s lead, the media accept the election at face value, focusing on the personalities of candidates, the surface mechanics of election day procedure, and other secondary matters and propaganda gambits, the most important being the alleged efforts to disrupt the election by the bad guys. They carefully avoid or downgrade issues such as the prior decimation of a political opposition, death squads as an institutionalized phenomenon, and the exclusion of major political opposition groups from participation.’

In regard to Iraq, for example, serious analysis was replaced by the simplistic message that, no matter how much killing the ‘coalition of the willing’ had done (with journalists consistently undercounting the death toll by an order of magnitude) at least ‘we’ had brought political freedom to Iraq.

But tragicomedy was always close at hand. On the BBC’s Newsnight programme, Jon Leyne reported that the victorious Shia United Iraqi Alliance would choose a new prime minister from two candidates: ‘both religious Shiites, but also both acceptable to the Americans’. (Leyne, Newsnight, February 14, 2005)

Leyne continued: ‘We call them a religious Shiite alliance… but they’re very sensitive to what the Americans would feel if guys with turbans took over this country.’

And indeed everyone, of course, knew that ‘democracy’ in Iraq had to be ‘sensitive’ to American concerns, not least in regard to ‘guys with turbans’ (which sounded like a euphemism for ‘towelheads’). It was obvious what ‘acceptable to the Americans’ meant for the claim that the elections were in any real sense ‘free’. Brent Scowcroft, national security adviser to Bush I, made the point in April 2003:

‘What’s going to happen the first time we hold an election in Iraq and it turns out the radicals win? What do you do? We’re surely not going to let them take over.’ (Quoted, Walter Gibbs, ‘Scowcroft Urges Wide Role For the UN in Postwar Iraq,’ The New York Times, April 9, 2003)
That was clear, as was the lesson implicit in the punishment meted out to Iraq’s third city, Fallujah, just weeks before the election. Smeared by the media as an insurgent stronghold, the city was subjected to all-out assault by US forces leaving 70 per cent of the houses and shops destroyed, and at least 800 civilians dead. Also, in October 2004, the prestigious scientific journal, The Lancet, published a report estimating that almost 100,000 more Iraqi civilians had died than would have been expected had the invasion not occurred.

The media turned a blind eye to this and much other evidence clearly challenging the claim that elections were conducted in the ‘absence of coercion and fear on the part of the general population’ and without ‘the prior decimation of a political opposition’. Instead, with smoke still rising from the ruins of Fallujah, the likes of Ewen MacAskill in the Guardian reported that Iraq was preparing ‘for the country’s first democratic election’. On a baking hot day this week, the people of Libya’s most prosperous city flocked to the beach and splashed in the cooling waters of the Mediterranean. Such happy scenes were unthinkable in Misrata a year ago, when the world watched in horror as Muammar Gaddafi’s forces encircled and besieged this port city, unleashing what he called the ‘forces of Hell’.
Firing thousands of tank shells, mortars and missiles into residential areas, the Libyan dictator was determined to smash the uprising in Misrata, only three hours from his underground stronghold in Tripoli, the capital.
To add to the terror, he sent thousands of troops into battle, many of them African mercenaries who had been allowed into Libya in return for their undying loyalty to the despot. Gaddafi told them: ‘Misrata is yours.’ There was carnage. While local men were fighting back against Gaddafi’s troops, their homes were looted and their wives and children kidnapped. Rape was widespread, death everywhere.

Today, a year on from the horrors endured by ordinary Libyans, Misrata’s buildings remain riddled with holes from bullets and tank shells. But shops and cafes are open. There are funfairs for children. And there are those families enjoying the beach.
Yet there is one stretch of sand where no soul ever ventures. This is an area of scrub and dunes just back from the sandy coves.

Called Funduq Al-Jannah - Arabic for Heaven Hotel - it is an execution ground where up to 1,000 of Gaddafi’s fighters were taken by the victorious rebel army, then slaughtered in cold-blooded vengeance.

Everyone in Misrata knows of the events that unfolded at this desolate spot, but no outsiders had been here until I visited this week and heard the full harrowing details of what happened at Heaven Hotel - a bitterly ironic name, as I shall explain.
The killings highlight the bitter divisions and violence in Libya as its people vote today in their first election for a 200-member national assembly that will name a prime minister, enact legislation and appoint a committee to draft a constitution.
For the truth is that, since Gaddafi fell, Libya has been run by a National Transitional Council which has overseen a descent into anarchy.

A report from Amnesty International this week warns the country is in the ‘stranglehold’ of hundreds of militias acting above the law. The organisation says widespread human rights violations - arbitrary arrests, detention, torture (sometimes to death), unlawful killings and forcible displacement of families - are rife in the country.
The levels of repression are reaching those that sparked the revolution against Gaddafi in the first place, and, according to the charity, methods of torture include ‘suspension in contorted positions and prolonged beatings with various objects, including metal bars and chains, electric cables, wooden sticks, plastic hoses, water pipes and rifle-butts’.
‘Some detainees were subject to electric shocks,’ it adds. ‘Without immediate action to stop abuses and lawlessness, there is a very real danger Libya could end up reproducing and entrenching the same patterns of violations we have seen in the past four decades.’
I was told of what happened at Heaven Hotel by a group of fighters I came to know at the height of Gaddafi’s siege of the town last year. They drove me to the spot up a bumpy dirt road past a beach crowded with families.
Here prisoners captured by the rebels were ordered to get out of the pick-up trucks into which they had been bundled after being tortured at rebel bases.
These Gaddafi fighters were the ‘worst of the worst’, I was informed - rapists and sadistic killers. Many had been mutilated and made to drink diesel - a form of torture common in Libya - and confessed to rape before being taken to the killing ground near the sea.
Misrata’s rebel fighters reassured them they would not be harmed, that they were simply being taken for questioning at the ‘hotel’. It was a lie. As soon as the captives arrived, the killing started.
‘I’d told one of these dogs that we were taking them to Funduq Al-Jannah near the beach - he was really pleased and said that was good because his aunt lived in the area,’ a Misratan revolutionary told me. ‘We cut his throat first.’

The prisoners’ hands were bound with plastic ties. They were ordered to lie on their side, with their heads on piles of sand. All my guides were involved, saying they had held the legs of the prisoners while their throats were cut with bayonets. Every one of them denied killing any captives themselves.
‘We burned some of the bodies before burying them in the sand,’ I was told. ‘I don’t know how many were killed - as many as 1,000.’
Most died in the immediate aftermath of the end of the war last August. But sources say people were still being taken to Heaven Hotel earlier this year.
The bodies were buried in a gulley across the sand from where we stood, explained my guides. Here, bulldozer tracks criss-crossed the area. The machines had been used to make large piles of sand and rocks to cover the bodies.
In blinding white sunlight, I scraped at the one of the piles of rock and sand. I found shoes, flip-flops and empty machine-gun cartridges near the surface. The men with me said this was a mass grave.
Later, I spoke to dozens of militia fighters. All told the same story: that Gaddafi fighters suspected of rape or particularly brutal killings were slaughtered here for their crimes.
Senior military sources in the city also acknowledged the existence of Heaven Hotel. Indeed, older, wiser leaders in Misrata were horrified when they learned soon after the war that the prisoners were being killed in such a manner.
They ordered that, in future, all executions had to be carried out with a single bullet in the head - rather than by holding the victims down and cutting their throats.
‘After that, we always shot them,’ another militia fighter told me. ‘It was quicker and cleaner - better for everyone.’
Many of the victims were from Tawerga, a town 30 miles from here, where some 50,000 black Libyans once lived in happy co-existence with their neighbours in Misrata.
But since Gaddafi fell, the rebels have been targeting its black population in indiscriminate revenge attacks for the despot’s deployment of thousands of African mercenaries recruited from outside the country against them.
Some Tawergans undoubtedly took money to join Gaddafi’s forces. But vast numbers never joined in the fighting - and are being attacked simply because their skin colour  is associated with Gaddafi’s mercenaries.
Today, Tawerga has been ethnically cleansed of its black Libyans, and largely destroyed. Militia fighters regularly drive out there from Misrata to make sure none of the population have sneaked back in.
Signs bearing the town’s name have been painted over. What remains of the shattered homes, shops and restaurants have been daubed with vile graffiti: ‘Black dogs! No blacks.’

A group of ‘freedom fighters’ told me how they had ransacked the town, setting fire to buildings and attacking anyone they found. These men told how they repeatedly kicked a heavily-pregnant Tawergan woman in the stomach. One said: ‘The woman was shouting as we kicked her: “I could be your mother.”
‘I told her my mother is not a black b***h,’ he added.
Some 25,000 Tawergans have now been placed in ‘refugee camps’, which are, in effect, little more than prisons.
The people in these camps do not dare leave: Misrata militias scour the country for anyone from Tawerga and regularly kidnap and torture black Libyans suspected of helping Gaddafi.
And even in the camps, fortified with barbed wire and watched by armed guards, the refugees are not safe from the marauding militias.
In a series of attacks, fighters from Misrata have opened fire on camp residents, killing both men and women. The latest happened at a camp for 1,700 Tawergans in Tripoli this week, when men from Misrata in four cars attacked with guns.
So bad has the situation been that some want the Nato-backed rebels to be tried for war crimes. The tragic irony is that Britain, France and the U.S. imposed a no-fly zone and helped overthrow Gaddafi to stop him committing war crimes.
Medical charities now refuse to work in Misrata. They pulled out after accusing rebels of bringing torture victims in for treatment - only to take them back for more torture once their wounds had recovered sufficiently for their bodies to cope.
A senior member of the city’s military council stressed that only rapists and the worst Gaddafi soldiers were executed at Heaven Hotel - and seemed baffled by any misgivings.
‘These people killed our families and raped our children,’ this influential figure told me. ‘If you rape, you must die - you have no rights.’
Nor, apparently, do critics of the killings. In recent days, one Libyan journalist was abducted by Misrata militias from the seafront in Tripoli, the capital, after saying these armed groups are out of control and need a ‘stick taken to them’.
Sulaiman Dougha, the country’s equivalent of David Dimbleby, was found in Misrata 72 hours after being snatched by men in balaclavas. He was tortured and sexually assaulted before being freed with a warning to leave the country - or be killed.
Not all are bent on vengeance. Mohammed Al-Koor, who runs one Misrata prison containing 700 Gaddafi supporters, had to move prisoners from cells visible from high buildings nearby, after Misrata snipers started killing inmates through the bars. In another disturbing development, these acts of revenge are now fuelling a new ‘rebel movement’ among Gaddafi supporters, financed by loyalists to the dictator who have escaped into neighbouring countries with billions.
For today’s election, thousands of police have been ordered on to the streets to show the world that Libya is safe. But the police are the only people in this country without guns: the militia fighters who overthrew Gaddafi with the help of British-backed Nato airstrikes say they cannot be trusted with weapons.
At the same time, fighting is raging in the south, where a brigade of Gaddafi loyalists, the Eagles of Muammar, has repeatedly tried to seize control of the airport in Sabha, a strategically vital city.
With a huge arsenal of artillery, mortars and missiles, followers of the dead dictator aim to push north towards the coast - and vow to avenge their leader, who was captured by rebels last October before being tortured and killed.
And in Sirte, where Gaddafi was found hiding in a sewage pipe, residents say they have had enough of the killing and kidnapping of suspected Gaddafi supporters - and are ready to fight back.
‘People still love Gaddafi, but they are scared,’ said one man. ‘Militias from other places come here every night and snatch men and boys from the streets. They say they come here to find guns, but they just want to kill people.’
With the country descending into a spiral of lawlessness and revenge, and with no national army to impose order, people all over this vast country are stock-piling weapons.
Zuba, an 18-year-old former rebel, showed me his personal arsenal of heat-seeking missiles, five Kalashnikovs, phosphorous grenades, ordinary green grenades and two rocket-propelled grenades.
Before leaving the country, I went back to Heaven Hotel alone early one morning to reflect on the degree of hatred that led to the slaughter there.
When I was reporting on the siege a year ago, I witnessed some of the atrocities inflicted by Gaddafi’s men - scenes of carnage and overwhelming grief I will never forget. This is Misrata’s bloody revenge.

1. (C) In response to March 10 ref (C) demarche to his 
deputy, MFA Deputy DG for Strategic Affairs Jeremy 
Issacharoff told polmiloff that the GOI, while fully 
cognizant of "what's at stake" in gaining consensus for a 
Libya resolution, is unhappy with the reftel Libya resolution 
language because it could set an unfortunate precedent for 
future GOI interests on both WMD and Middle East peace 
issues.  The GOI, he said, believes that the language implies 
support for a Middle East NWFZ and overstates the value of 
the Libyan decision for Middle East peace.  He worried 
specifically about the possibility that Iran could one day 
refer to the language as justification for international 
pressure on Israel. 
 
2. (C) Issacharoff said he was especially unhappy to have 
heard from GOI representatives in Vienna earlier in the 
morning that the U.S. had reportedly acquiesced to the 
Egyptian request (ref A) to reverse the order of the ref (C) 
formulation "at peace and free of WMD."  Reversing the 
formulation, he said, would unacceptably imply that WMD 
disarmament would be a condition for, rather than a result 
of, peace between Israel and its Middle East neighbors. 
 
3. (C) In an earlier conversation (ref B), Issacharoff's 
deputy, Alon Bar, said the GOI was instructing its delegation 
in Vienna to seek more acceptable language.  Issacharoff said 
language along the following lines would be acceptable to the 
GOI:  "Recognizing that the decision of Libya could make a 
contribution towards a more secure Africa and Middle East 
that would be eventually free of WMD."

Libya: Africa After Gaddafi - Full Spectrum Dominance - Kenya And Somalia The Next Targets.

On Monday, 22 August 2011, Africa fell to the beginning of the New World Order (NWO), and Full Spectrum Dominance when the Sovereign Libyan Government was toppled with the aid of the North Atlantic Treaty Organization (NATO), The European Union (EU), Gulf Cooperating Countries (GCC), and NATO Sponsored Terrorists imported from CIA Sponsored Training Grounds of Afghanistan, Yemen, Turkey, Jordan and Qatar.

The Libyan Nation is now in turmoil with the Country split into two halves, Tripoli representing the Western half of a very insecure and unstable country, and Benghazi the Eastern half. Chaos prevails in both halves, killings; kidnappings for ransom and revenge murders are daily routines for the gangs of armed “Liberators” who refuse to lay down their weapons in support of a singular State. With Gaddafi gone, Libya will not have prosperity or Security for at least the next 30-years, destabilizing neighbouring states starting with Niger, Mali, Algeria and Tunisia.
Now the United States of America and its allies from among the EU/NATO Member States and GCC Countries (Saudi Arabia, Qatar and Jordan), as well as Turkey are now embarking on the destabilization of the West and East African Region. Specifically, Kenya and Somalia in Eastern Africa, Niger and Mali in Western Africa for economic, natural resources and military purposes, key among them is to halt the growing dominance of China’s influence over Africa.

On Sunday, 10 June 2012 in the early hours of the morning, a Kenyan Police Helicopter crashed killing all six Souls on board, including George Saitoti, Minister of State in the Office of the Kenyan President, in charge of Internal Security and Provincial Administration, whooversaw the launch of the war on the so-called Al-Shabab terrorist militia as part of the African Union’s efforts to stabilize Somalia. This incident seen in isolation would have been forgotten quite quickly if was not for the US Military’s’ concept of Full Spectrum dominance, defined as the cumulative effect of dominance in the air, land, maritime, and space domains and information environment that permits the conduct of joint operations without effective opposition or prohibitive interference. Professor Saitoti had intended to stand in the forthcoming Presidential Elections and was widely considered to be a front-runner in the race to succeed the present incumbent, Mwai Kibaki whose term ends in 2013, Professor Saitoti was not acceptable to Washington but that is moot now....read more

Libya: War Criminal And Coward Nicolas Sarkozy Has Fled France Claiming To Be On Holiday In Canada.

Nicolas Sarkozy predicted that French police would come looking for him days before his marital home with Carla Bruni and his office was raided as part of an ongoing illegal campaign funding scandal.

Fraud squad officers and an investigating magistrate yesterday searched the Paris home of Mr Sarkozy and his wife, as well as the office he moved into since losing his re-election bid in May. Reports of a raid at the offices of a law firm where he is an associate were denied this morning.

Mr Sarkozy lost his judicial immunity as head of state two weeks ago.

Magistrates are investigating claims that house staff of Liliane Bettencourt, heiress to the L'Oréal cosmetics empire and France's richest woman, handed over brown envelopes stuffed with cash to Mr Sarkozy and his aides to finance his successful 2007 presidential campaign.
On holiday in Canada since Monday, Mr Sarkozy has made no public comment on the raids. But Le Parisien quoted him as telling friends in recent days: “I know they’ll come looking for me. Nothing will come of it all.”

He has previously dismissed suggestions he received illegal payments as an electoral “stink bomb”.

This morning Socialist interior minister Manuel Valls said: “(Sarkozy) is answerable to the law like anyone else. Justice must shine a light (on this case).” While insisting his role was to “respect the independence of the justice system, these inquiries, these raids”, Mr Valls added that France was going through a “moral crisis” after five years under Mr Sarkozy.

A judicial source cited by Libération newspaper said: “It was obvious even before these raids that judge (Jean-Michel) Gentil would summon (Mr Sarkozy). It is now inevitable.” ...read more

At the beginning of 2011, Libya had the highest human development indices in Africa, one of its highest literacy rates, education was available to all for free, housing was provided to all for free, transportation was subsidised, food was distributed for free. Communities regulated themselves through the Jamahiriya system, self-governance through People's Congresses. #Libya:#Megrahi - #WikiLeaks Proves Scotland Was Right On Megrahi Release.

We may never get to the root of the appalling events almost 22 years ago when 270 innocent people died as PanAm flight 103 blew up over Lockerbie.



But the WikiLeaks papers tell us much about the way in which public authorities across a number of countries behaved in the lead up to and aftermath of the release of Abdelbaset Ali Mohmed al Megrahi, the only man convicted of the bombing.



The picture that emerges from WikiLeaks may encourage a cynical view of government actions. We can, though, take some comfort from the documentary evidence that the devolved Government behaved impeccably. The leaks provide evidence that the Scottish Government did, indeed, make its decision on compassionate grounds and refused to be bullied into releasing Megrahi by the UK Government. The evidence of extraordinary cynicism on the part of the UK Government and its supporters is shocking. This is best summed up in a communication from US officials in the London embassy who informed Washington that “the UK Government has gotten everything -- a chance to stick it to Salmond’s Scottish National Party (SNP) and good relations with Libya” while Scotland got “nothing”.

It is clear from the documents that expectations of Megrahi’s approaching death prior to his release were shared by more than the Scottish Government. Preparations were in hand for the likely consequences of the Libyan prisoner’s death in Scottish custody involving an “immutable timeline”, as American officials wrote seven months before his release. UK officials had prepared for the prospect of Megrahi’s death in custody and were “focused on transfer under PTA [prisoner transfer agreement]”, believing time was short. The Libyan reaction to the arrest of one of Gaddafi’s son’s in Switzerland had been a sobering experience.

Against this backdrop, Libya’s intention to cease “all UK commercial activity in Libya” immediately, reduce political ties and encourage demonstrations against “UK facilities”, as well as implicit threats to UK citizens in Libya, could not be taken lightly. It is impossible to know how long Megrahi would have lived had he not been released but the indications are that UK and US officials were preparing for an imminent and serious backlash.

While US Government spokesmen have portrayed the Lockerbie bombing as an essentially American event, US officials took a very different view prior to the release of Megrahi. They feared that US interests would be attacked in the event of the Libyan prisoner’s death if the Libyan Government “views the Pan Am 103 case as a joint US-UK issue”. American officials wrote of repercussions “even if we remain neutral”, a discussion of neutrality that sits uncomfortably with the subsequent US official position. ...read more

Libya : The BBC Admit Their Fabricated Reports On Libya And Iraq Facilitated NATO Strikes.

So the BBC are actually admitting that theirs and their NATO country media counterparts could have actually brought about TWO illegal aggressions both in Libya and Iraq. And no-one bats an eyelid.  The role of the media is to be the eyes and ears of the public, not a war tool. That the BBC are admitting that they have been the latter and not the former shows to me how the western capitalist elite know so very well that the populations in their home countries have absolutely no interest in resisting their criminality, a criminality which they are very very very open about.
This further confirms my dreaded feeling that not only will we not see any real change brought about by peoples in the NATO countries (US and western Europe) but they will continue to be part of their elites efforts to sabotage genuine progressive and revolutionary change in the South.

Extradition To Libya - Extradition To Torture.

The reports that the former Libyan prime minister who was extradited by Tunisia to Libya was tortured highlight the lack of justice and proper institutions in post-Gaddafi Libya, believes journalist Lizzie Phelan. The French lawyer for Al Baghdadi al-Mahmoudi said on Wednesday that her client had his ribs broken and a lung punctured after prison guards seriously beat him. "According to the information I have, it seems that he has been beaten," said lawyer Marcel Ceccaldi as quoted by The Guardian. 

"He is in hospital, under guard." The Libyan authorities however denied the report as rumors. "We would like to say it's wrong, a naked lie that he was attacked and is in a sort of coma. Al-Bagdadi al-Mahmoudi is in good health and he is in need of nothing, God willing," said a NTC spokesman. 

Tunisia extradited the former Libyan prime minister back to his home country on Sunday despite concerns by human rights groups and the Tunisian president himself that al-Mahmoudi could face torture and an unfair trial there. 

Tunisian leader Moncef Marzouki denounced the extradition as “illegal” saying it was done without his consent. There are no signs that a fair trial can take at the moment in Libya, Press TV correspondent Lizzie Phelan said in an interview with RT.

(d) 1.(S/NF) Summary. Your visit to Libya will set the tone and agenda for the bilateral relationship over the next several months. Libyan officials seek clarification of the Administration's policy toward Libya, especially after their mishandling of the Fathi al-Jahmi case, and are unsure of the degree of engagement they can expect.

They continue to complain that Libya has not been adequately "rewarded" for previous policy decisions to give up its WMD programs and support for terrorism, yet they are remiss in meeting key WMD deadlines.

You can lay out the path toward increased engagement in the wake of the new Washington consensus and press for real progress.

Potential deliverables from the visit include: a statement announcing the intention to engage in a Human Rights Dialogue and a Political-Military Dialogue with high-level State officials; Libya's signing of the HEU-LEU transfer agreement; formation of a visas working group to discuss bilateral visa problems; and setting a date to sign a Trade and Investment Framework Agreement (TIFA).

You can also privately raise the notion of establishing a Civil-Nuclear Dialogue, incumbent upon GOL signing of the HEU-LEU transfer agreement. The Libyans will be looking for a concept of how we envision conducting the human rights dialogue and assurances regarding the possibility of a meeting between POTUS and Qadhafi on the margins of UNGA. They will also continue to press for security assurances. End Summary.

PRESSING LIBYA TO FULFILL ITS WMD COMMITMENTS

2.(S/NF) The GOL has been credited with having largely met its WMD commitments; however, the recent track record is worrisome and suggests that it may be deliberately delaying implementation of commitments it has undertaken under the rubric of the U.S.-U.K.-Libya Trilateral Steering and Coordination Committee (TSCC). The GOL has delayed since November 2007 signing a U.S.-Libya agreement for the return of spent nuclear fuel (the HEU-LEU agreement); delayed signing a parallel Russia-Libya agreement; and given no details on plans to sell its uranium yellowcake stockpile.

 If work on the spent nuclear fuel transfer to Russia is not completed by September 30, 2009, the Department of Energy's work to complete the program may be delayed for upwards of two years.

The GOL has also delayed the implementation of its commitments under the Chemical Weapons Convention (CWC) to destroy its remaining stockpile of declared chemical weapons (approximately 25 MT of mustard agent and 860 MT of chemical agent precursor chemicals).

The deadline established by the CWC Conference of the States Parties for the destruction of Libya's mustard stockpile is December 31, 2010; destruction of the remaining inventory of precursor chemicals is to be completed no later than December 31, 2011.

3.(S/NF) A proposed visit by ISN DAS Mitman in late June to discuss Libya's WMD obligations and rewards was scrapped at the eleventh hour when the GOL failed to issue visas to the delegation. GOL interlocutors recently blamed the Prime Minister for slow-rolling on Libya's WMD commitments.

 A GOL official told the DCM that the Foreign Minister planned to address the issue with Qadhafi and that he understood that inaction by the Prime Minister-equivalent, who still views renewed bilateral relations with suspicion, is detrimental to the relationship.

 Post believes the GOL is slow-rolling, in part, as leverage against a guarantee to discuss security assurances. We urge you to press your interlocutors on the need to expeditiously sign the agreement, linking that action (the signing of the HEU shipments) to any future discussions regarding cooperation in the civil nuclear field and a Civil-Nuclear Dialogue.

ENGAGEMENT OPPORTUNITIES: HUMAN RIGHTS DIALOGUE

4.(S/NF) During a recent meeting with the Ambassador, FM-equivalent Musa Kusa expressed agreement on behalf of the GOL to launch a Human Rights Dialogue, whereby the U.S. and GOL would discuss sensitive human rights issues - in both a general and specific sense - and provide a forum for joint-action in the human rights sphere.

You should lay out for the FM a concept of how we envision the dialogue and get agreement for the official launch of the dialogue next month by a team of USG officials. MFA A/S-equivalent Ahmed Fituri has hinted that the GOL may press for inclusion of the Human Rights Dialogue as part of a broader strategic dialogue. The meeting with Musa Kusa may be the appropriate venue to publicly announce our intention to initiate the human rights dialogue.

VISAS AND NSEERS

5.(S/NF) Post began full nonimmigrant visa operations for Libyans in April.

Since that time, we have issued over 1000 non-immigrant visas to Libyans with wait times that range from a TRIPOLI 00000584 002.2 OF 003 few days to several weeks due to Security Advisory Opinion requirements.

The GOL continues to adhere to restrictive visa issuance policies vis-a-vis Americans, including an apparent virtual ban on tourist visas for Americans, lengthy delays and exorbitant fees for American business people, and a long record of visa refusals for USG-sponsored visitors for academic, cultural, science, economic, and other programs.

The GOL has agreed, in principle, to the idea of forming a bilateral visa working group to resolve these issues, including visa reciprocity. During a July 6 meeting with the Ambassador, Musa Kusa maintained that visas for Americans would continue to receive the most scrutiny of any foreign visitors to the Jamahiriya, for security reasons.

 Your underscoring for the Libyans that the current imbalance in visa issuance is not sustainable will show your interlocutors that the issue has been raised to high levels in Washington.

6.(S/NF) An ostensibly related issue involves the treatment of Libyan travelers at U.S. ports of entry, particularly Libyan officials, who are routinely separated from other passengers at ports of entry and questioned extensively about their travel.

GOL officials, who view the issue as a personal affront, will raise it with you.

Musa Kusa and UNPermREP Shalgham are only two of the several high level Libyan officials who have been "mistreated" at our ports of entry, and their experiences have engendered deep resentment here. Your recent letter to DHS described the issue well; we believe that we will not be able to make significant process on visa reciprocity until we make some headway here. A DHS delegation is scheduled to visit Tripoli in late July to address treatment of Libyan officials at U.S. ports of entry/NSEERS issues with GOL counterparts, among other issues. However, the GOL has not yet granted visas to the delegation.

TRADE AND INVESTMENT FRAMEWORK AGREEMENT

7.(S/NF) USTR has been working with the GOL to finalize a TIFA text for over a year. The GOL last invited Emboffs to review the draft text on November 24, 2008. Despite post's attempts to discuss TIFA with Libyan trade officials at every possible opportunity, the text has languished on the Libyan side. We would like to press the GOL to sign a TIFA as soon as possible. We concur with USTR view that the signing should take place even in light of renewed problems regarding Caterpillar and potential problems involving the Chevrolet dealership. We may have a better hand to play on these issues when we can argue them out in this formal framework.

MEGRAHI

8.(S/NF) The Megrahi case is likely to be an agenda item for your interlocutors. Qadhafi raised the issue during his July 9 meeting with UK PM Gordon Brown, and recent press reports suggest that Megrahi's physical condition is deteriorating (although the UK Embassy was not able to corroborate such reports during a July 19 meeting with the CDA). If the issue is raised, we recommend that you remind Libyan officials that the decision to allow a Prisoner Transfer Agreement (PTA) for Megrahi is a matter for the Scottish Government to decide. UK Embassy officials believe that a PTA decision could be forthcoming in mid-August. We defer to the Department's view on a possible request for Megrahi's compassionate release.

REGIONAL ISSUES

9.(S/NF) While Libya's regional focus at present seems to have concentrated primarily on its pan-African agenda, Qadhafi has skillfully leveraged the AU Chairmanship to ingratiate himself with European and South American leaders - most recently Silvio Berlusconi.

His visits to Moscow, Madrid, Paris, Lisbon, and Rome have afforded him opportunities to sign military-to-military agreements and to engage on civil-nuclear issues, as well as to negotiate commercial energy and investment deals.

 He has even exploited EU, especially Italian, concerns about illegal immigration to press forward his security and political agendas.

 As Qadhafi's engagement as an African leader has expanded, he has notably decreased his efforts in the Arab world.

Nevertheless, he continues to tout his vision for a one-state solution between the Israelis and the Palestinians - "Isratine" - including during his May meeting with AFRICOM Commander General Ward. The Libyans will appreciate anything you can relate regarding the work of Special Envoy Mitchell and how we see Administration policy playing out in the peace process.

POTUS-QADHAFI MEETING
10.(S/NF) The desire on the Libyan part for a POTUS-Qadhafi meeting at UNGA in New York is palpable. In our discussions here, we have implicitly linked a "good atmosphere" for that meeting to Libyan agreement on the human rights dialogue. With their assent to that proposal and the handshake in L'Aquila, the Libyans will seek assurances that the meeting will happen. To the extent you can bring any further clarification on that, the more warmly you will be welcomed by your interlocutors.

BUILDING A HOME BASE

11.(C/NF) On the embassy front, we have experienced significant personnel changes, and the new team is settling in nicely. We are disappointed that the move of the entire embassy to the villa site has been pushed back by several weeks, but we are looking forward to the time when the mission will be united. We have a good LES staff, but they have not been fully integrated into the embassy ethic given the distance between the two sites.

12.(C/NF) We continue to need high-level engagement from the GOL to facilitate our efforts to purchase a property for a New Embassy Compound (NEC) and close the deal on compensation for our seven U.S. properties here in Tripoli.

You may also want to seek the Prime Minister's assistance in resolving outstanding payments due under the compensation agreement for our seven properties.

The Land Registry Office claims that it has not received funds to implement the agreement, while the Ministry of Finance claims that the Land Registry Office has the funds. We believe the Prime Minister's intervention will be needed to resolve this standoff. POLASCHIK
